Titan Recruitment (Energy) is currently seeking out a Commercial & Contracts Manager for our clients Energy & Infrastructure Project Delivery team.
In recent years, our client has seen considerable growth within all business units. Having recently won some of Queensland's largest connection projects, they are now looking to scale the team. This position is suited to someone that has worked within the Renewable Energy space for a number of years. The successful candidate with have experience working for or alongside EPC's and OEM's as well as extensive experience of contracting and subcontracting principles, project controls, forecasting and risk management.

Position Purpose
The Commercial and Contracts Manager role will be accountable to effectively develop, negotiate, coordinate and manage all commercial and contract related matters across the Energy Infrastructure works portfolio to protect our client and its parent company's commercial interest throughout the entire project and contract lifecycle across multiple clients and projects. The role will take a proactive and pragmatic approach to the management of risk, contractual obligations and relationships between the company, parent company, clients and suppliers.

Key Accountabilities
• Accountable for managing commercial risk exposure and corporate compliance associated with the negotiation of contracts. This requires liaising with General Counsel, Regulation and Pricing, and all other key internal stakeholders to achieve suitable outcomes.
• Accountable to ensure that time, cost, quality and scope is accurately reflected and clearly administered for each contract as well as verification of technical scope and commercial quantum through the negotiation and execution phases of head contracts (e.g. extension of time claims, scope variations etc.).
• Embed commercial contract management practices across assigned work portfolios and projects ensuring effective application of contractual terms and conditions against compliance, commercial, safety and delivery performance objectives.
• Establish commercial contract arrangements for delivering assigned work portfolios and projects ensuring commercial strategies, plans and objectives are established and contract management outcomes achieve commercial, compliance and delivery objectives.
• Manage key internal and external stakeholder relationships including leading complex negotiations and providing recommendations to all stakeholders to optimise our clients commercial position, resolve commercial disputes and resolve issues so that required commercial results are achieved.
• Accountable to establish, implement, monitor and manage the company's rights, obligations and contractual mitigation strategies under relevant contract forms throughout the full contract lifecycle.
• Accountable to work closely with the bid/tender/pre-contracts team/s to ensure tendered scopes, quantum and risk areas are clearly defined through to each awarded contract.
• Analysis of Project Controls data for monitoring of contract performance and provide advice and recommendations to continually improve the way contracts are managed and reported.
• Effectively manage information and confidentiality requirements across EQL in accordance with applicable ring-fencing parameters
• Collaborates effectively managing information and confidentiality requirements across the parent company in accordance with applicable ring-fencing parameters.
• Compliance with all relevant state and national legislation, policies, procedures and practices.

Required Skills
• Demonstrated commercial experience managing large infrastructure fixed price contract projects in a national competitive market with firm contractual terms and conditions of contract that will need to be passed on to subcontract engagements.
• Extensive experience of contracting and subcontracting principles, cost control, project controls, forecasting and risk management.
• Demonstrated advanced knowledge and application of the electricity act, regulations, codes of practice, security, of payments acts (conditional to each state), environmental and workplace health and safety practices associated with electrical network infrastructure.
• Demonstrated advanced knowledge of contractual instruments and their application, including methods for resolving contractual disputes.
• Strong commercial acumen demonstrated by the ability to negotiate large commercial contract arrangements and manage contractor and contract performance in line with business objectives.
• Extensive knowledge and experience in technical project delivery sequencing, quantity surveying and ability to draft and execute high risk commercial contracts and identify and resolve contractual issues.
• Good working knowledge of Australian Standard contracts for design and construct and construct activities.
• Demonstrated ability to prepare and manage contracts that allow project deliverables to be achieved safely, under budget and on time with an effective balance between commercial returns and risk.
• Proven well-developed interpersonal, written and verbal communication and negotiation skills, with an ability to develop good working relationships with internal and external stakeholders to identify, understand and act on customer needs and expectations.

Requirements
Essential:
• Australian Working Rights
• Industry Degree (Engineering, Construction, Project Management, Law, Commerce)
• 5 years minimum Power/Energy related industry experience

Desired:
RPEQ and/or CPEng qualified
